A DuPage County CDL Lawyer Will Help Protect Your Commercial Drivers License

If you drive for a living, your driver’s license is your career, and a single ticket can jeopardize your ability to earn a living. In addition, commercial drivers are often held to a higher standard than private drivers and face stiffer penalties if convicted of a traffic offense. As a result, you need a DuPage County CDL lawyer with experience in handling CDL tickets to ensure you get a fair result.

Handling All Types of Chicago CDL Violations

Whether you have been charged with a minor infraction or a major violation, a DuPage County CDL lawyer can help you understand the potential consequences and get it resolved. At the Law Offices of Michael Stefanos, we help commercial drivers resolve the following violations:

  • Improper driver’s license classification
  • Expired safety sticker
  • Improper registration
  • Overweight vehicle violations
  • Equipment violations

Of course, any ticket can be highly problematic for commercial drivers, not just those specific to commercial driving. We help CDL holders fight their tickets and get a fair resolution for the following violations:

  • Speeding
  • Following too closely
  • Failure to obey a traffic control device
  • Improper lane usage
  • DUIs

Whatever violation you have been charged with, we can help you protect your license.

CDL Disqualifications

Illinois statute 625 ILCS 5/6-500, et seq. governs the operation of commercial vehicles and CDL licensing requirements. The potential consequences of your ticket will depend on the nature and seriousness of your offense. The main factor is whether or not you were ticketed for a “serious” or “major” violation.

Serious violations include the following:

  • Speeding 26 mph or more above the speed limit
  • Tailgating
  • Reckless driving
  • Texting while driving
  • Improper lane change
  • Driving without a CDL or without having it in your possession

A 60-day disqualification will be imposed if you receive two serious violations within three years. A 120-day disqualification will be imposed if you receive three severe violations within three years.

Major violations, however, will result in an automatic disqualification of one year. A second major violation will result in a lifetime disqualification. Major violations include the following:

  • DUI or refusal to take a breathalyzer test
  • Leaving the scene of an accident
  • Committing a felony while driving
  • Driving a commercial vehicle while your CDL has been disqualified
  • Negligently operating a commercial motor vehicle and causing someone’s death
  • Participating in the manufacture or distribution of a controlled substance

Commercial drivers should be aware that they can face a major violation due to a ticket they received while driving their private vehicle. Whether you received your ticket while driving for work or while you were off-duty, a DuPage County CDL lawyer can explain how it could impact your CDL.
